Our services are primarily geared towards small and mid-sized businesses, though we also work closely with a number of large corporate clients. Our clients are based throughout Germany as well as in neighboring countries. We also represent clients from further afield, most of whom are based in the United States, Japan and China. We also serve clients from Sweden, France and Italy.
Our office, the first patent law firm in the city of Neuss, was founded in 1977. In 1996, patent attorneys Paul and Albrecht joined and founded Paul & Albrecht Patentanwaltssozietät.
Since 2018 we are a partnership with limited professional liability according to German law and carry the name Paul & Albrecht Patentanwälte PartG mbB.
The German legislature has introduced this kind of partnership according to the " Gesetz zur Einführung einer Partnerschaftsgesellschaft mit beschränkter Berufshaftung und zur Änderung des Berufsrechts der Rechtsanwälte, Patentanwälte, Steuerberater und Wirtschaftsprüfer (PartGGuaÄndG)" which came into force on July 19, 2013. For a PartG mbB the professional liability is limited to the assets of the partnership. The German legislator demands that such a kind of partnership fulfills increased requirements regarding the coverage of the professional indemnity insurance, in detail the statutory minimum coverage sum is EUR 2,5 million for each insurance claim. These increased requirements have already been met by us before the change of legal form. Our current coverage exceeds this minimum sum.
The city of Neuss is a major city in North Rhine-Westphalia with approximately 150,000 residents. Located on the left bank of the Rhine directly across from the state capital, Düsseldorf, it is among the oldest cities in Germany. The close proximity of Neuss to Düsseldorf is a true advantage, as Düsseldorf is home to both the Regional Court and the Higher Regional Court. These serve as the courts of general jurisdiction of first and second instances for all litigation related to intellectual property. The vast majority of such legal disputes in Germany are litigated before these two courts.
The Düsseldorf Airport is the most important international airline hub in the state of North Rhine-Westphalia and is the third largest airport in Germany. Our office is conveniently located a mere 15 kilometers from the airport, which is a mere 20 minutes drive by car.
Our spacious, well-appointed office provides a pleasant backdrop for meetings and presentations. Ample visitor parking is conveniently located directly in front of the main entrance.
Our extensive in-house reference library contains a wide range of technical literature as well as the latest editions of virtually all publications - also those that are technical or scientific in nature - pertaining to the areas of law in which we specialize. That means we’re able to take all relevant published legal opinions and rulings on a given subject into account when dealing with legal problems and expert opinions in particular.
Security is one of our top priorities. Our office shares the Bürgschaftsbank’s cutting-edge security system, which is monitored around the clock by a security services firm.
As patent attorneys, we are bound by law to maintain client confidentiality. This confidentiality applies to any and all information that becomes known to us in the course of carrying out our professional duties, with the exception of self-evident facts or information of an order of significance that does not warrant it (§ 39a Abs. 2 PAO).
The obligation to maintain confidentiality remains in place upon termination of the retainer. This obligation is only lifted if the legitimate rights of a patent attorney clearly outweigh the client’s interest when asserting or preventing claims relating to the retainer or in defense of his or her own interests (§ 2 BOPA).
All of our employees are also obligated to maintain client confidentiality (§ 17 Abs. 8 BOPA).
